These Terms of Service (“Terms”) are an agreement between you and Servestack, Inc. (“Servestack”, “we”), a company headquartered in Boston, Massachusetts, and govern use of the Servestack platform and websites. By creating an account or using the service, you agree to these Terms.
Plans & billing
Monthly plans renew monthly. Annual plans renew yearly. You may cancel at any time; refunds for the unused portion are issued at our discretion.
Acceptable use
Don't use Servestack to violate laws, infringe rights, or send unsolicited communications. We reserve the right to suspend accounts in violation.
SMS & text messaging program
Servestack, on behalf of the restaurants it serves, operates a text-messaging program that sends order confirmations and updates and provides a conversational ordering assistant. By texting one of our ordering keywords, opting in on a restaurant’s ordering page, or providing your mobile number when placing an order, you consent to receive these messages at the number provided. Consent to receive messages is not a condition of any purchase.
- Program: order updates and conversational ordering from participating restaurants, powered by Servestack.
- Message frequency: varies based on your orders and activity.
- Cost: message and data rates may apply, per your mobile carrier plan.
- Opt-out: reply STOP at any time to stop receiving messages. Reply HELP for help.
- Support: email support@servestack.ai or contact the restaurant directly.
- Carriers: mobile carriers are not liable for delayed or undelivered messages.
We handle mobile information as described in our Privacy Policy. We do not sell or share mobile opt-in data or phone numbers with third parties for their marketing.
Data
Restaurants retain ownership of their guest data and menu content. Servestack provides hosting, processing, and access services under license.
Service level
Servestack targets 99.95% uptime on Scale plans. Service credits are available for verified outages per our SLA. See our Security & Trust page for how the platform is protected.
Disclaimers & limitation of liability
The service is provided “as is.” To the maximum extent permitted by law, Servestack's aggregate liability arising out of these Terms or the service is limited to the fees you paid us in the twelve months preceding the claim. Neither party is liable for indirect, incidental, or consequential damages.
Termination
You may cancel per the billing terms above. We may suspend or terminate accounts for material breach of these Terms after notice where practicable. Upon termination, restaurants may export their guest data and menu content for 30 days.
Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws principles. The exclusive venue for disputes is the state and federal courts located in Suffolk County, Massachusetts.
Changes
We may update these Terms from time to time. Material changes are announced by email or in-product notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
